(AP) ? Laurence Fishburne has been granted a temporary restraining order against an ex-convict who claims to own the actor's home and went there on New Year's Day to try to evict him.

The order requires Anthony Francis, whose real name is Mark Francisco, to stay 100 yards from the Oscar-nominated actor and his wife and daughter.

Francisco was sentenced to serve two years in state prison on a cyberstalking conviction in 2010, and court records show he spent time in a state mental hospital for that case. He pleaded no contest to cyberstalking after being found competent to stand trial.

Francisco went to the Oscar-nominated actor's home Jan. 1 and told Fishburne's wife that they were living there illegally. Police were called and based on Francisco's agitated demeanor and criminal history, they advised Fishburne to seek a restraining order, the court filings state.

Francisco also left a handwritten letter threatening to evict the Fishburnes and called police in recent days to try to get them to leave, the filings state.

Attempts to reach Francisco for comment were unsuccessful.

Fishburne and his wife, Gina Torres Fishburne, have owned their home for 10 years, his filing states.

"This is a case of stalking, and the judge had no problem in issuing a temporary restraining order to stop it," Fishburne's attorney Donald Etra said.

Francisco has a 1993 conviction for burglary in San Diego, court records show.

The order temporary restraining order was granted Thursday. A court hearing on a three-year restraining order is scheduled for Jan. 23.

Fishburne starred in "The Matrix" series and was nominated for a best actor Academy Award in 1993 for "What's Love Got to Do with It." His wife is an actress, appearing in "24" and other television series.

June Thomas: Seth! I?m so glad to be wandering the halls of Downton Abbey with you for another season.

Seth Stevenson: June, I can?t wait to dance the black bottom with you again.

Thomas: As Sunday?s Season 3 premiere approaches, we law-abiding Americans can finally stop feeling like chumps for waiting for PBS to give us our fix. The long delay since ITV aired the show in the U.K. means that I?ve been spoiled on a couple of plot points, and I confess this causes me some dowager countess-level aggravation.

Stevenson: Somehow, I?ve managed to avoid all spoilers. (So far! Commenters, please preserve my maidenhood, and that of my fellow law abiders. I know there are major plot points floating around out there.)

Thomas: I was all set to take that aggro out on the show until I watched a 5-minute catch-up video on the PBS site, and now I'm once again pure of heart and excited to see what ridiculous adventures Lord Fellowes has in mind for us this time around. What about you? Feeling crabby? Breathless with antici ?. pation?

Stevenson: I, too, watched the catch-up video. And rewatched last year?s Christmas special. So I?m currently floating on a snowy cloud of marriage proposal bliss. Part of me feels like Downton should have ended right there, with the Matthew-Mary saga seemingly resolved. That?s always been the heart of the show for me. But I?m still looking forward to some dowager disses. To finding love for long-suffering Edith. To catching up with Sybil, her Irish hubby, and their baby?the ?Fenian grandchild,? as Lord Grantham so charmingly referred to his forthcoming kin. And don?t forget, Shirley MacLaine is on her way to Downton. I anticipate fireworks as she and Dame Maggie Smith attempt to out-battleax each other.

Thomas: A common theme of our discussion last year?and one I'm sure we'll return to this season?is how Julian Fellowes manages to win us over. Why is this show different from all other shows? When Homeland took a few turns toward the ridiculous everyone shrieked, but outrageous plot twists are what we come to Downton for. That's part of the appeal, anyway. It's the combination of the predictable (the Crawley girls will squabble, the dowager countess will zing, Thomas and O'Brien will plot, Anna will be loyal, Bates will be boring) and the bat-shit crazy (P. Gordon returns from the dead, Matthew loses sensation below the waist then miraculously regains it) that keeps us glued to our sets.

I agree with you, though, that for all the other folderol, the romance between Mary and Matthew is what makes the show special. Dan Stevens and Michelle Dockery have wonderful chemistry together. One look across a crowded room, one ridiculously romantic gesture, one lovely snowflake-frosted kiss is all it takes to make me forget boring Bob Crawley, his oddly spacey wife, and all the other stuff that I don't much care for.

Stevenson: Downton has always been a soap opera, so I think we forgive it the occasional outlandish development. Or we at least tolerate its absurdity. I confess I have been tempted to fast-forward through a few of the sillier storylines. And, despite my admiration for Carson?s nobility and Mrs. Hughes? humanity, I?m beginning to lose interest in the entire downstairs crew. Is it wrong that I sort of hoped Mr. Bates would be hanged so we could stop following the progression of his never-ending martyrdom? Perhaps the arrival of another new, fetching ginger housemaid will shake things up among the servants.

For me, the show?s true appeal?in addition to my personal fantasy of wooing Lady Mary and making a life with her in an enormous manor house?lies in its Jane Austen construction. Daughters of marriageable age, in mild economic peril, seeking suitable husbands. That?s a proven recipe for narrative success. But now we?ve safely delivered Sybil and Mary into matrimony. (Or so I assume. I suppose some soapy intervention could ruin Matthary?s nuptials.) So we?re left with Edith?s struggle, or with one of the existing husbands suddenly dying or turning into a fiend.

Thomas: Ah, Seth, your charming fascination with the Crawley girls proves that you are, at heart, an American. I am drawn to the servants hall. The Brit in me knows, without a shadow of a doubt, that that's where I'd live if I were part of the Downton menage. And so, although I have a Pavlovian response to the swell of Downton Abbey's romantic music and feel my heart flutter when Matthew whispers sweet nothings in Mary's ear, it's Thomas and O'Brien and poor dopey Daisy that I really relate to. It's them who I want to find true love.

Stevenson: Lest you think me a snob, June, I assure you that I identify more closely with, say, Branson the chauffeur than with cosseted Lord Grantham. It?s just that most of the downstairs players are so dang boring and/or unlikable. I can?t find it within me to cheer on the evil exploits of Thomas and O?Brien. I rooted for sweet, levelheaded Anna to make things work with Mr. Bates?until I began rooting for Mr. Bates to just disappear and stop bumming me out. I loved the plucky maid who learned how to type, but she was gone too soon. I really do hope that an appealing new servant or two will reinvigorate this flagging bunch.

This Wednesday, U.S. Citizenship and Immigration Services (USCIS) published the final rule for the family unity waiver, a new process that will allow U.S. citizens? spouses and children who are eligible for a green card to file their applications for family unity from within the U.S.

The process will be effective on March 4.??Currently, immigrants who are eligible for legalization because they have a U.S. citizen spouse or parent must return to their home countries to be interviewed for their visa. An immigrant who has been in the country for more than six months without legal status is banned from returning for either three or ten years once he or she departs.

This prohibition can be waived in cases of extreme hardship, but only once someone has left the country. The waiver decision can take months, during which time immigrants are separated from their families and are stranded abroad.

They also may have to wait in dangerous locations such as Ciudad Juarez, Mexico, the ?murder capital of the Americas.???As a result of these overly harsh restrictions, many immigrants prefer not to risk long-term separation from their U.S. citizen spouses and children and instead choose to remain in the country without documents, even if they are eligible for a green card.

?The family unity waiver is an important improvement to our immigration process,? said Ali Noorani, Executive Director of the National Immigration Forum. ?It removes a major obstacle to legal immigration and fixes bureaucratic hurdles that separate American families. Eligible immigrants will be able to come forward and legalize their status, and husbands, wives and children will not have to risk their lives to get their lawful visas.

?More can be done to make this good rule better. All immigrant families should be eligible for a family unity waiver, including the families of legal permanent residents ? well on the road to citizenship ? who experience equally compelling hardships of lengthy family separation?.

?In the long run, Congress holds the key to effective, top-to-bottom improvements to our immigration process, and they must pass laws that address harsh immigration policies that only serve to keep American families apart.?

Chinese investment in the United States will likely break another record in 2013, according to research firm Rhodium Group. That's after a record year in 2012 with deals worth more than $6.5 billion, a 12 percent increase from the previous record of $5.8 billion in 2010.?

"Given that we already have $5 billion worth of deals lined up it is very likely that 2013 will be another record year. Policy action in China that demonstrates commitment to structural reforms could further add to the momentum, as Chinese firms are seeking access to technology and know-how to prepare for a new era of Chinese growth," said Thilo Hanemann, author of a new Rhodium report about Chinese foreign direct investment in the United States.

In fact, the Chinese seem to be some of the few willing to increase investment in the United States since the financial crisis. From the first three quarters of 2007 to the first three quarters of 2012, Middle East Investment in the U.S. is down 86 percent, Canada down 75 percent, and Europe down 49 percent, according to the Bureau of Economic Analysis.

Hanemann thinks the government data undercounts the number, because it does not include flows through offshore financial centers. Rhodium estimates the increase in Chinese investment to the U.S. is actually a whopping 1300 percent.?

To be sure, China is still small relative to other parts of the world; less than 1 percent of total foreign investments in the United States. However, that number is only expected to grow as the country and its growing businesses continue to look for investments outside of their home country, as they search for commodities and value-added know-how. The biggest deals in 2012 were Sinopec's $2.5 billion stake in Devon Energy, and Dalian Wanda's $2.6 billion purchase of movie-theater chain AMC. Additionally, Wanxiang took a $420 million stake in Great Point Energy.?

Still waiting for regulatory approval: A Chinese consortium has agreed to purchase an 80 percent stake in AIG's aviation leasing unit Lease Finance Corp for $4.2 billion; auto parts maker Wanxiang has won the non-defense business of battery producer A123 Systems in a bankruptcy auction. BGI Shenzhen is waiting for regulatory approval to purchase California biotech company Complete Genomics for $118 million.?

"In short, we are in the midst of a structural growth story that will transform the China-U.S. investment relationship form a one-way street into a two-way street" wrote Thilo Hanemann, the report's author.?

(AP) ? Congress' excruciating, extraordinary New Year's Day approval of a compromise averting a prolonged tumble off the fiscal cliff hands President Barack Obama most of the tax boosts on the rich that he campaigned on. It also prevents House Republicans from facing blame for blocking tax cuts for most American households, though most GOP lawmakers parted ways with Speaker John Boehner and opposed the measure.

Passage also lays the groundwork for future battles between the two sides over federal spending and debt.

Capping a holiday season political spectacle that featured enough high and low notes for a Broadway musical, the GOP-run House voted final approval for the measure by 257-167 late Tuesday. That came after the Democratic-led Senate used a wee-hours 89-8 roll call to assent to the bill, belying the partisan brinkmanship that colored much of the path to the final deal.

"A central promise of my campaign for president was to change the tax code that was too skewed towards the wealthy at the expense of working middle-class Americans," Obama said at the White House before flying to Hawaii to resume his holiday break. "Tonight we've done that."

The bill would boost the top 35 percent income tax rate to 39.6 percent for incomes exceeding $400,000 for individuals and $450,000 for couples, while continuing decade-old income tax cuts for everyone else. In his re-election campaign last year Obama had vowed to boost rates on earnings at somewhat lower levels ? $200,000 for individuals and $250,000 for families.

Scores of GOP lawmakers voted for the measure, reversing a quarter-century of solid Republican opposition to boosting any tax rates at all.

The bill would also raise taxes top earners pay on dividends, capital gains and inherited estates; permanently stop the alternative minimum tax from raising levies on millions of middle-income families; extend expiring jobless benefits; prevent cuts in Medicare reimbursements to doctors; and delay for two months billions in budget-wide cuts in defense and domestic programs slated for this year.

Both sides lamented their failure to reach a significant deficit-cutting agreement. But neither much mentioned another omission: The immediate expiration of a two-year, 2-percentage-point cut in the Social Security payroll tax.

That break, which put an extra $1,000 in the wallets of typical families earning $50,000 a year, was an Obama priority two years ago as a way to boost consumer spending and spark the flagging economy, but it fell victim this time to other priorities.

House Democrats voted by an overwhelming 172-16 for the agreement, which was crafted over the weekend by Senate Minority Leader Mitch McConnell, R-Ky., and Vice President Joe Biden.

But Republicans tilted against it 151-85. It is rare for leaders to bring a bill to the House floor that will be opposed by most lawmakers from their own party, and the decision underscored the pressure GOP leaders felt to approve the legislation.

Boehner, R-Ohio, took no public stance on the measure before the vote. But he guided the compromise to the House floor after an unsuccessful attempt by many conservatives to persuade leaders to add spending cuts to the bill.

Had the House inserted those budget cuts and the Senate refused to consider them, the legislation could have died. That left House Republicans worried that voters might blame them for a huge, sweeping tax increase and for any swoon the nation's financial markets might take when they reopened Wednesday.

"You can be right and you can be dead right. Which is it?" said Rep. Rich Nugent, R-Fla., of the quandary Republicans faced. "Right now you need to take the tax issue off the table" and move on to a focus on curbing spending, he said.

Boehner voted for the bill, an unusual step because speakers seldom vote, and he was joined by Rep. Paul Ryan, R-Wis., the GOP's vice presidential candidate last fall. Voting "no" were the other two top GOP leaders, Reps. Eric Cantor of Virginia and Kevin McCarthy of California.

Passage came nearly 24 hours after a decade's worth of tax cuts enjoyed by tens of millions of Americans expired with the stroke of the new year, technically raising taxes by more than $500 billion in 2013 alone.

Those tax increases ? plus $109 billion in defense and domestic spending cuts that were to be automatically triggered Wednesday ? became known as the fiscal cliff. Economists warned that their combined impact would hurl the economy back into recession, but Obama's signature on the bill would prevent the "cliff" from taking hold.

Obama can sign the bill remotely using a machine called an "autopen," or the bill can be flown to Hawaii for his signature.

Overall, the legislation would add nearly $4 trillion to federal deficits over the next decade compared with what would have happened had all the tax cuts expired, according to the nonpartisan Congressional Budget Office.

"I'm embarrassed for this generation. Future generations deserve better," complained one foe, Rep. Louie Gohmert, R-Texas.

The agreement's journey to passage was a tortured one. It included negotiations between Obama and Boehner on a larger, deficit-cutting deal that collapsed, and a failed effort by the speaker to drum up enough GOP votes to pass a "Plan B" that would have limited tax boosts to incomes exceeding $1 million.

It took weekend talks between McConnell and Biden, former Senate colleagues, to craft the more modest package that focused on averting the worst impacts of the fiscal cliff while postponing any deficit reduction efforts to coming months.

Those first showdowns will come over the next three months, when the government's legal ability to borrow money will expire and temporary financing for federal agency budgets will expire. Republicans have already said that, as they did in 2011, they will demand spending cuts as a condition for extending the debt ceiling.

"Now the focus turns to spending" and overhauling the tax code, Boehner said in a written statement after the vote. He said the GOP will fight for "significant spending cuts and reforms to the entitlement programs that are driving our country deeper and deeper into debt," a reference to costly benefit programs like Medicare, Social Security and Medicaid.

In his White House remarks, Obama said that while he was open to compromise, he would demand deficit-cutting savings from added revenue on the well-off, not just spending cuts.

He also pointedly said he would "not have another debate with this Congress" over extending the federal borrowing limit.

"If Congress refuses to give the United States government the ability to pay these bills on time, the consequences for the entire global economy would be catastrophic ? far worse than the impact of a fiscal cliff," he said.

Though its focus was on taxes, the measure approved Tuesday would prevent a potential doubling of milk prices and prevent a $900 salary increase for members of Congress in March. Its extension of jobless benefits would help 2 million people out of work at least six months, and it would prevent a 27 percent cut in reimbursements doctors get for treating Medicare patients.

Weighing in with criticism of the compromise were the chief authors of an influential bipartisan deficit-cutting proposal, former GOP Sen. Alan Simpson and Democrat Erskine Bowles, a former White House chief of staff under President Bill Clinton. They called the measure "truly a missed opportunity to do something big to reduce our long term fiscal problems."

WASHINGTON ? With millions of baby boomers reaching retirement age, fears are mounting of the economic impact if they follow the pattern of previous generations by curbing spending and draining Social Security and Medicare benefits.

But the 78 million boomers ? born from 1946 to 1964 ? have always broken the mold in terms of setting trends, and some investors and business and community leaders see their retirement as no different. They see an unprecedented, multibillion-dollar opportunity to offer new products and services to an active demographic group that?s expected to live longer than previous generations.

When Elizabeth Reighard started her fitness training business in North Myrtle Beach, S.C., four years ago, most of her students were in their mid-30s. But now her client list is made up mainly of boomers, such as Mary Smith, 58, who hired Reighard to help her ?keep up with the grandkids.?

The demand for fitness trainers such as Reighard is expected to jump 24 percent in the next decade, largely because of baby boomers who want to stay healthy longer, according to the Department of Labor?s Occupational Outlook Handbook released in March.

?I?m seeing it more and more. Seniors know they have to be in better shape to have less aches and pains,? said Reighard, who?s also a boomer. ?Yeah, we?re getting older, but our bodies feel good. ... I look in the mirror and I might look 51, but I feel 25.?

The Census Bureau projects that Americans 65 and older will make up 19 percent of the population by 2030.

On the labor front, the health care industry is the most obvious benefactor of a longer-living active community. Demand for home health aides is expected to grow 70 percent in the next decade, according to the Department of Labor.

Demand also will be high in less obvious fields, such as for architects, who will be called on to build senior-friendly communities.

?It?s only in Washington that 100 million people are viewed as an unaffordable cost and financial burden,? said Jody Holtzman, a senior vice president at AARP. ?In the private sector, 100 million people are called a market and an opportunity.?

Concern about a drain on entitlements from retiring baby boomers has increased as talks intensify over avoiding the fiscal cliff. Boomers have been depicted as the elephant in the room. The Congressional Budget Office warned in June of a shortfall for entitlement programs, as aging boomers would consume a ?significant and sustained? share of benefits from Social Security, Medicare and long-term-care services financed by Medicaid, the health care program for the poor.

Those projections fail to take into account that boomers are expected to work longer and they?ve never followed in the footsteps of previous generations, said Matt Thornhill, an author of ?Boomer Consumer,? a book that examines marketing to the baby boomer generation.

Sam Farber created Oxo Good Grips in 1990 when he noticed that his wife had trouble holding kitchen tools because of arthritis, according to the company?s history. Farber saw a business opportunity in creating more comfortable cooking tools. Oxo now makes more than 850 products that appeal across generations.

Holtzman of AARP likes to share that story when he?s trying to inspire new entrepreneurs. He?s met with hundreds of venture capitalists, encouraging them to ask one additional question when entrepreneurs approach them seeking startup money: ?What?s your 50-plus plan??

?The one question a startup doesn?t want to get from its board of directors is this one: ?Why did you leave money on the table by ignoring a market of 100 million people with $3.5 trillion to spend??? he said.
